As the first step in this strategic alliance, the judge on leave Vicente Tovar joins the Madrid office of RSGM as a partner to direct the Criminal Law area at the national level. This move is part of the firm's growth strategy, which adds advice on Criminal Law to its portfolio of services.
Tovar explains to Economist & Jurist that today “in such a globalized world it seems unthinkable that an office dedicated to business law does not have a criminal area that helps companies in different situations that may arise. If you want to grow you must have a Criminal Law area where compliance and money laundering issues are also worked on.”
In fact, it confirms the evolution of Criminal Law Email Data itself “which has gone from blood crimes and other issues, which also remain, to being more sophisticated, with the presence of companies that, as the Penal Code points out, can have their criminal liability as legal entities. Today, in the economic sphere, criminal offenses are well established and the line between what is legal and what is a crime is not always visible.”
In the end “ we find a very specialized Criminal Law . This forces us criminal lawyers to know well what Commercial Law is, also what is related to bankruptcy and insolvencies, as well as to know well the tax problems in companies that can also be a crime on certain occasions. Everything has evolved and companies have advisors specialized in criminal practice to maintain their legal security.”
Regarding the bankruptcy reform of Law 16/2022, which is now celebrating its anniversary, Vicente Tovar recalls the treatment given to negligent bankruptcy . Not too many have been seen, but some of them can lead to criminal proceedings , especially if it is shown that this bankruptcy has been carried out fraudulently to harm creditors. This means that both companies in a situation of insolvency and the offices that manage these restructurings work side by side with us criminal lawyers on these issues.”
